David Temple Trial
David Temple was convicted by a jury on August 6, 2019. David Temple has been on awaiting trial and was waiting for his sentencing. This was because of the Covid-19 pandemic. David Temple was one of the several cases that were put on hold because of the pandemic.
The Supreme Court of Texas in 2020, extended the time before regular trials could continue. The Director of Victims Services for Crime Stoppers, Andy Kahan could not contain his joy and relief but was quickly submerged when the jury could not decide on the punishment.
David Temple also requested a third trial after a decision was not met and punishment was not agreed on. His sentence would have been between probation and life imprisonment. But the jury did not agree on his punishment forcing a judge to declare a mistrial in the punishment phase.
Despite the outcome, both their request for a third trial and also a change of venue was bluntly turned down. The punishment was to have been done in March 2020 but at that time there were more than 30,000 criminal cases that were pending in Harris County District Court which was one of the reasons they requested a change of venue.

What Was David Temples’s Crime?
David Temple’s wife Belinda was 8 Months pregnant when she was shot and killed in the couple’s Katy home in 1999. Belinda died of shotgun damage to the back of the head. Prosecutors said that David Temple wanted his wife dead because he was having an affair.
David Temple married his mistress Heather Scott less than two years after the murder of his wife. However, Heather Scott filed for divorce after his second trial began on July 8. David Temple was originally convicted of murder in 2007 and served nine years in prison before a judge tossed his conviction. The Judge concluded that the prosecutor Kelly Siegler withheld favorable evidence from the defense.
